The old texas statute stated that a child 12 years of age or older could file with the court in writing the name of the parent who the child would choose to have the right to determine where they lived subject to the approval of the court. Turning 12 does not allow the child to decide if they will go live with mom or dad.
However this age is not an automatic age a child can decide which parent to live with. Under the old law a child age 12 or older could file with the court the name of the parent who the child wants or chooses to decide where the child should live. This is the new statute and repeals the old law found in 153 008.
While this was subject to the court s approval it did not mean that a child age 12 or older could choose which parent he or she would live with.
